What a horror story, problem is that if he is processing the data for
domestic purposes he will probably be unlikely to face prosecution even if
he is infringing your relatives DP rights. The issue also arises about the
Human Rights Act and the right to privacy of family life.
I would recommend contacting the local police who may be able to send a
local patrol officer around to try to reason with the gentleman. On a
person (not political) note I would probably contact the media and try to
shame the offender into ceasing the activity, I'm sure the local paper or
"neighbours from hell" would love to do an article on such an abuse of
technology.

I hope that the list won't mind me asking a slightly personal (rather than
work related question) regarding CCTV.
A family member is having problems as his neighbour has put up CCTV cameras
around the property. As my uncle's house is next door all the too-ings and
fro-ings from his house is also being filmed. He's asked me if he has any
recourse under DP, as his neighbour is filming and keeping these images.
What is slightly more of a concern is that he has images of my Uncle and
friends (going about their business in their own houses) up on a notice
board in his house as my family member found out when he called to try and
reason with him!
I am a little challenged by this! Presumably this is a clear breach of the
CCTV guidelines issued by the OIC, but does the law apply in the same way
to an individual as it would to a company?
Any ideas would be welcome, and thanks for indulging me with this little
personal question!
