Can I advise caution. Few debt collection companies are aware of their
responsibilities under DPA. Ensure that your instructions are in writing,
clear , precise and refer to DPA. Ensure that they are registered under the
1984 act or have notified under the 1998 act. I realise that they will be
your data processors but more than likely they will first access one of the
credit data bases to build up a profile on the debtor. This would then make
them joint data controllers with the credit reference agency. I would argue
that this would then make them joint data controllers with you but this is
something I aired some months ago and perhaps is not part of this discussion.
