That was my understanding, too.
Now just suppose for a minute that the information that you release is
critical to the prosecution of the case. And also that the defence questions
whether the notice that was presented to you was valid. You now end up in
the witness box being asked to explain why you released the data to police
on the basis of what was written on the form.
In these circumstances would you feel confident that you had exercised due
diligence when determining that the form was a valid request?
