Paul
I do not know of a recent case. Be interested if someone digs this up.
Several years ago a case was brought under DPA 84 by the then Registrars
office against an employee of the Woolwich.
My recollection of the basis of the action was that the employee had
disclosed the fact that mortgage arrears existed to a tenant of the mortgage
holder.
As the Woolwich had not had 'tenants' registered as potential disclosures,
the employee was prosecuted for making a reckless disclosure outside of the
declared
register entry. The association with register entry no longer exists
although if the disclosure is one that company policy or processes would not
sanction as 'authorised' a criminal prosecution can still occur under
section 55 of the DPA98. Interestingly in the Woolwich case the DP Manager
for the company was called as a prosecution witness, a position they were
not particularly happy about.
Hope this may assist

Subject: phone messages
I am writing to ask if you have any details about a fairly recent case,
believed to be last summer, in which action under the DPA was taken against
a woman for revealing confidential information to the relatives of her
firm's clients when answering and dealing with telephone calls. One of our
section managers, who deals with rent arrears, saw this case and has since
instructed her staff that they should only give their name and direct
telephone number when leaving a telephone message for a client on the
grounds that giving the name of the organisation and section could indicate
that the client was being contacted about rent arrears, which is
confidential information. This is not in line with our customer care policy
and the problem needs to be addressed. Our manager does not have any further
details of the case so any information that you could let me have about it
would be very helpful.
