Have read the replies - which are interesting - but I am led to believe that MS HOTMAIL, being a free service with massive amounts of e-mails floating around, does NOT keep backups (Worth checking though). Likewise if an a/c is not used for 90 days - it is deleted. Also, how do you prove that the individual accessed the A/c from office PC and not home PC?? Which puts a slightly different slant on things!

Your comments please:
A member of staff uses a personal mail account (e.g. hotmail) to discuss a
data subject, as opposed to their usual work account. The data subject
makes a subject access request, specifically mentioning the personal email
account. Is there any way of searching for material sent via this
personal account ? Is it exempt because it is a personal account anyway,
or is that irrespective since the account was used on the employer's
premises to discuss work-related matters ?
Anyone have any thoughts on this or have experience of a similar situation
?
