Does he not have exactly the same rights as if the company held the data
within this country?
The company are 'processing' within this country by collecting the data and
on the surface they certainly appear to meet the criteria of a 'data
controller', even if they have some difficulties with data quality. From
what was said none of the Schedule 4 requirements are met.
Should they not therefore have a representative acting on their behalf
within the UK as required by section 5(2)&(3)?
I should think that contacting that representative would help to inform your
flatmate.
Now how do you find out who the representative of a foreign data controller
is? :-)
