You do not have to be speeding for roadside devices to start collecting data. SPECS cameras (see www.speedcheck.co.uk) collect data in order to calculate your vehicle average speed between two points. I raised questions about speed cameras on the OIC web cast last year and the answer was that pictures collected by speed cameras fall within the act. Speed Check Services, the company behind SPECS cameras, are registered under the data protection act, and their registration is on the web (X4175354) . They also seem to trade in personal data. I don't know if they are the data controller or whether they act as a data processor for someone else (like the police or the local authority).
