Skill is planning to respond to these regulations in due course.
Our main concern relates to grey areas in defining student services. First
of all we do not think it is sufficiently clear that the list of services
covered is a selective list of those services most likely to be perceived as
doubtful/borderline. There is a statement after this list saying that all
student services are covered, not just the list, but we think this point
should be flagged up more clearly. Secondly, we are concerned that transport
is not mentioned.
In terms of the leasehold regulations, we have noted a few loopholes that
need to be removed. (In addition, we are involved in expanding the post-16
code chapter on leasehold to include the content of the regulations).
We are also considering how to respond to the section on justification of
discrimination. We have concerns in this area too.
We were not expecting to respond to the list of specialist colleges, but
would be looking to NATSPEC to do this.
