Main speaker and chair: Andrew Charlesworth, Senior Lecturer in
Information Technology law at the University of Hull and author of the
Senior Management Briefing Paper on the Data Protection Act 1998
(http://www.jisc.ac.uk/assist/) and the forthcoming JISC report "A
Survey of the Legal Issues Relating to the Development and Use of
Internet Related Technologies at Educational Sites"
The Data Protection Act (DPA) 1998 is longer and more complex than the
existing Data Protection Act 1984. It contains several new concepts
and some significant departures from current law and comes fully into
effect on 1 March 2000.
The DPA 1998 has significant consequences for HE institutions and FE
colleges, which collect a vast amount of personal data every year:
staff records, names and addresses of those requesting prospectuses,
examination marks, residence and catering information, references,
information from applications, fee collection and other administrative
functions, as well as some types of research data.
All computerised processing of personal data and many structured manual
records will eventually be subject to the provisions of the Act.
The seminar and workshop will take the form of a mix of presentations
and discussion based sessions.
Guidelines on the DPA are being produced and will be available on the
day.

Break out sessions:
- data protection hypotheticals: aimed at less experienced attendees
- data protection solutions: a number of HE and FE institutions have
already sent questions to the Data Protection Registrar. At present
there does not appear to be a collective analysis of the replies. It
would be useful to find out what different institutions have been told
and to identify any problem areas
- data protection issues: to gain a clear picture of the key questions
and issues considered relevant to the FE and HE sectors. This could
provide the basis of, and the support for, a lobby for particular FE
and HE exemptions.

Main Speaker and Chair
Andrew Charlesworth is Senior Lecturer in Information Technology Law at
the University of Hull Law School, where he teaches IT law,
Intellectual Property law and EU law. He is heavily involved in the
practical aspects of Information Technology law in Higher Education
having played a wide-ranging role in developing information technology
and data protection policies for the University of Hull. He has also
written briefing papers and opinions on copyright, software licences
and data protection for JISC and UCISA and consulted on rights
management issues for the Arts and Humanities Data Service. His recent
work on data protection includes:
· The annotations to the Data Protection Act 1998 for Sweet & Maxwell's
Current Law Statutes;
· The article "Implementing the European Data Protection Directive 1995
in UK Law: The Data Protection Act 1998" (1999) 16 Government
Information Quarterly 203;
· A chapter for the forthcoming book Law and the Internet 2: Regulation
of E-Commerce eds. Edwards & Waelde;
· A Senior Management Briefing Paper on the Data Protection Act 1998
for JISC Assist;
· Conference papers and lectures given at the University of Edinburgh
and University of Warwick in the UK, and the University of Western
Ontario and Brock University in Canada.
He was responsible for organising the JISC Seminar "Facing the Legal
Challenges of Providing Internet Access In Higher Education
Establishments" in October 1997, which attracted widespread attendance
from, and publicity in, UK HEIs. He has lectured on IT issues in
Europe, North America and Australia.
