I have read the Code of Practice and understand data subject's right of
access, but still do not understand why anyone should wish to see the CCTV
of themselves? Unlike text data on computer/paper it cannot be inaccurate,
or slanderous. It simply records an event (like someone walking down the
street). The data subject does not need to see image, to know what they
did. Why should they wish to view unless, they have just carried out, or
are about to carry out a criminal activity and want to see your CCTV's area
of coverage, or am I just being very cynical!
Another question I have on the issue of CCTV is, in the forward to the Code
of Practice Elizabeth Francis says "This code deals with surveillance in
areas to which the public have largely free and unrestricted access...".
Does that mean that it covers the reception areas of companies, or just
external cameras onto the pavements, etc? From the contents elsewhere I
would think it covers inside the building, but would appreciate other
options as although the reception does receive members of the public, it is
hardly an area of " free and unrestricted access"?

The advice from the Commissioner's Code of Practice is that: Yes,
a data
subject can ask to see tapes with themselves 'in view'. If 3rd
parties
are also captured, these would need to be 'blurred' through editing
techniques. Another extremely costly activity, no doubt.
The only time data subjects don't have the right to view material is
where
a criminal investigation would be jeopardised.

We are embarking on getting our CCTV things up to date. My query

what could a data subject ask to be disclosed from a CCTV operation?
Could we have to play back tapes to find a particular clip? And if
we do
then what ... if the person sees it s/he sees other persons too and
so on.
