Who are the data controllers of the lists? Appears to me the controllers
are the 'list owners'
If so Newcastle University was providing a 'computer bureau' service under
the 1984 act and are data processors under the 1998 act. (Indicates a need
for list owners to have data processor contracts!!)
If this proposal is correct it appears that Newcastle are saying they will
not follow the instructions of the data controllers!!
This view is made from an uninformed viewpoint in that I know little about
the mailbase setup other than the terminology of 'list owner' and
'mailbase', but those terms alone seem to indicate that the University do
not own the lists. If they are stating otherwise, do they control all the
list owners and take responsibility for all the content of the lists?
A similar debate within my sphere was rapidly clarified when this argument
was presented and the situation amicably resolved.
