This is an agreement that I drew up with assistance from our Legal Services to deal with a specific instance where we needed to make a data file available to the IT supplier; the wording will now serve for similar occasions in the future.

Data Protection/Confidentiality Agreement
between
(1) The Council of the Borough of ******** of the Town Hall, ********* Street, *******************, and
(2) **** Limited of _______________________
Dated April 17 2000
Agreement in respect of the disclosure to ***** Limited by ****************** Council of files containing personal information, in connection with the supply of IT Services.
(1) ****LIMITED shall not use or divulge or communicate to any person (other than those whose province it is to know the same for the purposes of provision of the IT Services, or with the prior written authority of ************** Council ("the Client")) any personal data contained in files disclosed to **** LIMITED by the Client, which it shall treat as private and confidential and safeguard accordingly.
(2) **** LIMITED shall, immediately upon receipt of any files from the Client, and before any other process or operation involving those files, scramble all data fields that would permit identification of any individual whose details are contained in them, so that no identification of any individual will subsequently be possible.
(3) **** LIMITED shall ensure that its employees, agents, subcontractors and any third parties to whom data is disclosed under (1) above are aware of and comply with the Data Protection provisions contained in (1) and (2) above and **** LIMITED shall indemnify the Client against any loss or damage which the Client may sustain or incur as a result of any breach of confidence by any of such persons.
(4) The provisions of this Clause shall survive the termination of this Agreement but the restrictions contained in (1) shall cease to apply to any information which may come into the public domain otherwise than through unauthorised disclosure by **** LIMITED, its employees, agents or sub-contractors.

Hi again - hope you have all had a good Easter holiday - up here in Scotland
we don't get it but we do get the May Day.
I wonder if you can help - during e-mail training staff are informed that
our IT Customer Support staff can take control of their pc (Desktop) with
the knowledge of the individual user. Staff, both IT and departmental have
concerns as to the confidential information which may appear on screen (e.g.
Social Work clients) and that by so doing they may be in breach of the Data
protection Act.
The Head of IT has asked me to draft a statement which IT Staff can sign and
any contractors to the effect that the information would remain confidential
and that they would not breach this confidence. I think it may be similar
to one I signed years ago when I worked with the Civil Service but that was
so long ago I can't remember how it was worded.
Can anyone help:-
1. Has anyone had experience of this?
2. Has anyone drafted a confidentiality statement in similar terms? If
so, any chance of a copy.
I have tried the Internet with no success.
