Hello Doreen
The new DP Act repeals the whole of the Access to Personal Files Act 1987,
and consequently any regulations made under that Act (see Schedule 16, DP
Act 1998)
Records formerly covered by the 1987 Act are known as "accessible records"
under the new DP Act, defined at Schedule 12 of the Act.
Subject Access to these records is now covered by the DP Act (from 1 March
2000)
Stuart

Subject: Social Work - Access to Files
Can you help - which legislation takes priority?
Access to Personal Files Act 1987
Access to Personal Files Act (Social Work) (Scotland)
Regulations 1989
Data Protection Act 1998.
My impression is that the Access to Personal Files Act takes precedence over
the DP Act?
