I am aware that some public sector organisations, when asking for references
for an individual, state that they have an open policy with regard to
references and staff have access to all their personnel information. At
that point the organisation knows the rules and will couch their reference
in appropriate terms (or not!) if they think it will be open to scrutiny.
There is also an argument that one should never write a reference about an
individual which you would not be happy for them to see!
