My impression of this is that strictly you would be unable to contact the
people on the database for marketing purposes. Presumably if the list has
never been used for that purpose then this is a 'new' purpose and would
therefore require one of the conditions in schedule 2 to the 1998 Act to be
in existence.
On the other hand it is difficult to get someone's consent without
contacting them. I think the DPC are a little flexible on this and allow
persons to be cotacted once. If they opt in then they can be contacted
again. If they do not respond then you are correct that they must be treated
as having opted out.
