You only need permission from the students if you are planning to use the scripts for teaching and learning purposes.
It does say in the JCQ booklet that if you intend to use them for that purpose, then written consent must be obtained, emails are acceptable.

If you dont have written consent from students for access to scripts (bulk request in the region of 200+ students) but are told by your ELT/SLT that all have been contacted by phone and have verbally agreed would you accept this?
