We frequently work with intellectusl property rights from projects.
Following Schumpeter invention is the first succesful use of a new technology. To patent a design you normally don't need to prove that it works however.
Patents laws differ between countries and regions.
In general you need to show that your design is unique in some respect. What are the critical parts of the invention?
In many legal spaces, particularly the US, the biggest task is to verify that no one else already holds a patent of similar invention. The boundaries are precisly that vague.
You may well be awarded a patent, only to find yourself in court over (alleged) infringment of another patent. No patent bodies themselves guarantee that a patent is undisputable.
I would seriously recommend the inventor get in touch with an IP/patent law firm.
Today almost investor require IP rights to engage.
