According to the Internet Archive's own forum, everyone could upload
to archive.org digital files produced by G.:

Since the Internet Archive is a non-profit organization, I suppose
that this is why G. have let them collect and distribute their scans.
If it had been a problem, G. would have already reacted long ago.
Reportedly, the Internet Archive has now accumulated around 900,000
books scanned by G. (https://en.wikipedia.org/wiki/Internet_Archive).
Not bad, even though it means that 12 million books or so have yet to
be freed from the metadata inferno of G. Books...
