Dear Sharon/Janet
It's called the Egg-Shell syndrome - he/she is vulnerable and
forseeability from the employer's perspective - if the employee has an
existing medical condition which can be made worse by work and the
employer has this information, the employer has an additional duty of care
to ensure that the employee's condition is not 'made worse/exacerbated by
work.' See 'Walker versus Northumberland County Council.' For example,if
you have an employee with depression caused by excessive workload off
work, ensure when he returns to work that his workload is reasonable by
risk reduction/reduced to a manageable situation to avoid an exacerbation
of his/her condition with open discussion regarding work ability/any
concerns for some weeks following return to work.
Best regards
Catherine Mackay
