We've also been chased (like many authorities) by PRS re:music at Rhyme
Times and have been seeking guidance. Paula Sutton from Booktrust would
like to share this info on PN & listening posts with the list:
"I wonder if you want to feed back the information I was given in
relation to this. The PPL who are responsible for collecting royalties
for performers and producers would not consider charging libraries a
licence fee for a person to look at or listen to material on the peoples
network. A licence is only required for a "public performance" and they
do not consider two people sat in front of a screen, one wearing the
headphones, to be a public performance !
Both PRS and PPL agree that listening posts require a licence as this
equipment has been installed especially for a "public performance". Fair
enough maybe.
If the PRS and PPL don't agree on the interpretation of the copyright
law regarding the peoples network then this is definitely a matter that
needs looking at nationally and not locally."
