Dave's bell curve analogy is wonderfully demonstrated by the CIEH Stats Guidance. Part 2A asks you to prove that the site is SPOSH, where as planning (under Chris's scenario) asks you to prove that the site is not SPOSH. If we imagine that the output was an unsafe level and a safe level there would be a wide area between the two levels that represented the uncertainty.
So even using Chris scenario it is unlikely that you would see

100mg/kg = safe
As it is Parliament has given the main responsibility for planning matters to LPA's, so providing we work reasonably to fulfil our overarching responsibilities (in other words we are sensible) its up to the LPA to set local policy. This is entirely consistant with the NPPF
