However, I always thought that case law had determined that 'stupidity' didn't necessarily negate a claim but would certainly decrease the award.
I agree it will be interesting to see how things go.
On a similar note, the ET case I am involved in was, once again cancelled at the request of the litigant (backed by their GP who unsurprisingly parroted the same reason as the employee word for word ) at the 11th hour (i.e. 6 pm the night before) and the person in question has 2 more claims lined up so we need to get this one done despite the on going costs. The stress of trying to deal with it all is huge as I have to keep the doctor calm as well. We keep jumping through hoops and they don't even comply with the courts but when they want a delay they get it. Justice - I think not.
Vexatious litigants need to come with warning signs - 'Risk to health and peace of mind'......
Some people always need someone else to blame because they cannot bear to think they may actually be responsible themselves... If someone has any bright ideas on how to recognise the precursor stage so we can avoid this sort of thing, let me know
