medieval-religion: Scholarly discussions of medieval religion and culture

The library which owns the book (if it is indeed medieval) cannot be
said to hold the copyright, since anything that old is now legally in
the public domain. They can certainly try to monopolize access to
photographs of the work and can certainly charge people for copies of
photographs and for permission to publish those photographs, but in most
of the world, it is very difficult to maintain copyright control of
photographs of such old material. Anyone trying, for example, to sue
someone for copyright infringement for using their photograph of the
Mona Lisa would have to prove that there is an artistic quality to the
photograph that differentiates it from all other photographs of the Mona
Lisa. Ironically -- and fortunately for researchers -- the better
quality the depiction of an ancient work of art is in a photograph, the
harder it is to maintain copyright control of it.
