Perhaps this reference has been brought up already, but one of the classics on Personality in law is:
/Personality in Roman Private Law/, by P. W. Duff, and the beginning and end of the book explore the importance of the concept for religious organizations. The
last chapter is relevant to the church, since it considers the extraordinarily broad discretion (revolutionary in its scope) that Constantine I gave to the church. One can almost hear the
professional lawyers at court whispering in horror, "Does he have any idea what he has done?"
I cannot imagine the church, after being given this astonishing power to gather (and, even more significant, to alienate) property would let that power dwindle in any sense.
