So it appears that the U.S. Patent and Trademark Office has rejected all 44
of Blackboard's patent claims:

What amuses me greatly is that prior art is referenced, specifically
mentioned (see: issue 1 on page 3 of
http://www.desire2learn.com/patent/USPTO%20Non-Final%20Action.pdf) is an IMS
Specification document which, as contributing members, Blackboard must have
indirectly paid for.
Ooops!
I hope they have to reimburse Desire2Learn's legal costs, that'd teach them!
