Hi Annie,
The basic evidence is on the FMed3 itself. It says there in red letters
“for Social Services and Statutory Sick Pay Purposes Only”. You might wish
to point this out to the HR department.
I can't see why this would compromise liability if specific OH advice has
been sought AND followed. Many of the insurers now run their own OH
provider organizations and it is unlikely that they will have one part of
the business advising something that the other part repudiates (but you
never know). If there is doubt about this, ask the company to confirm this
with the insurer.
