It is apparently possible to set up a template for all messages to the list
to include a disclaimer which could be along the lines of yours or Mike's
suggestions. If list members felt that this would be appropriate we could
certainly investigate this further.

As the sparker of the debate both in the THES (I'm not sure that that
description is justified) and the sparker of the current onlist debate
(there has been off-list debate between Phil, the list owner and myself), I
have lurked for the last week to see what other list-members think, and also
to miss the THES copy deadline ;-)
There are several points I would want to make:
1. I welcome Phil's participation in the list and support the principle
that he should be able to report this debate to a wider audience.
2. I have reservations about the way it has been reported. These arise
mainly because an email Phil sent me has never arrived, and he made the not
unreasonable interpretation that my silence was acquiescence.
3. The on-list debate during the last week suggests that future debate
will be stifled, at least with respect to many list-members. This is
worrying.
4. The JISCMail guidelines are in my opinion ambiguous. On the one
hand they state "When you send a message to a JISCmail list, you retain your
copyright in that message. You also retain your moral right to be identified
as the author of the work, and your moral right against derogatory
treatment.", which suggests that the poster retains copyright and thus
control; on the other, they state "you have a right to expect ...
attribution is given to the author. The name of the original sender should
always be acknowledged. Any appended copyright notice is respected" The
problem arises in the case of a poster who does not want to be attributed.
JISCMail seems to assume that every poster on every occasion wishes to be
identified - hardly a realistic assumption.
5. It would seem that we need a clear and precise disclaimer if we do
not wish to be identified when quoted. One possible solution would be to
put 'Posted under the Chatham House rule' - (see
http://www.chathamhouse.org.uk/index.php?id=14) Indeed, it would seem
sensible to me that any JISCMail list might operate under the Chatham House
rule - it protects posters' anonymity by default, placing the onus on the
journalist to seek permission to name the source, yet allows what is said to
be reported. It has a noble history for off-the-record briefings to
journalists - 'sources close to the Prime Minister said...' [Well, perhaps
not that noble!].
What has been disappointing in the last week has been the lack of
contributions on the original debate - the 'rationale' for 'all-or-nothing'
approaches to the admissibility of plagiarism evidence.
