We had something similar and the Police reform Act 2002 was quoted, I thought that was more applicable to a driver than our patient who was a hit and run victim. My understanding is the police can have a sample taken but not analyse it without consent. If the patient remains unconscious can the Consultant and/or next of kin give consent?
