Now I've had a chance to do a fuller search, the source of this regulation
seems to be constitution 18 of Lateran IV, which is quoted verbatim in
Gratian as a decretal of Gregory IX (Lib. III. Tit. L. cap. ix - Friedberg
and Richteri: CIC volume II columns 659-660). There are ten footnotes to
this canon in F&R which refer to works not easily available to me.
Tanner and Alberigo (Decrees of the Ecumenical Councils) refer to F. W.
Maitland's "Roman Canon Law in the Church of England" (London: 1898), pp
162-163 and St. Kuttner's "Kanonistische Schuldlehre von Gratian bis auf
die Dekretalen Gregors IX (Studi e testi, 64)" (Vatican City: 1935) p 244.
