This issue has come up on a number of occasions in ireland as a result of
litigation. Most departments offer 24 hour middle grade cover now as a
result of the judgement.
As we share a common legal system and there is quite a lot of cross
referencing if that is the correct term then I suppose what happens in
Ireland could be cited as precedent in the UK.
You should try to get your hands on a copy of the case O Connor v Mid
western health Board, I think it was. Pat Plunkett has the reference I
