In Case C-317/95,
REFERENCE to the Court under Article 177 of the EC Treaty by the Simvoulio
Epikratias for a preliminary ruling in the proceedings pending before it
between
Canadane Cheese Trading amba,
Adelfi G. Kouri AEVE
and
Ipourgos Emboriou,
Ipourgos Ikonomikon,
Ipourgos Igias, Pronias kai Kinonikon Asfaliseon,
Ipourgos Georgias
(Ministeries of Commerce, Finance, Health, Welfare and Social Security, and
Agriculture)
on the interpretation of Articles 30 and 36 of the EC Treaty,
THE PRESIDENT OF THE COURT OF JUSTICE,
after hearing the observations of Advocate General Ruiz-Jarabo Colomer,
makes the following
Order
1.
By order of 20 June 1995, received at the Court on 10 October 1995, the
Simvoulio Epikratias (Council of State) referred to the Court for a
preliminary ruling a number of questions on the interpretation of Articles
30 and 36 of the EC Treaty.
2.
By a letter of 24 June 1997, received at the Court on 27 June 1997, the
Simvoulio Epikratias informed the Court that, by a judgment of 24 June 1997,
it had decided to withdraw the questions referred to the Court of Justice
for a preliminary ruling. It did not state the reasons for that decision.
3.
In those circumstances, removal from the register should be ordered pursuant
to Articles 77 and 78 of the Rules of Procedure.
Costs
4.
The costs incurred by the Danish, German, Greek, Austrian and Finnish
Governments and by the Commission of the European Communities, which have
submitted written observations to the Court, are not recoverable. Since
these proceedings are, for the parties to the main proceedings, a step in
the proceedings pending before the national court, the decision on costs is
a matter for that court.
On those grounds,
THE PRESIDENT OF THE COURT OF JUSTICE
hereby orders:
Case C-317/95 is removed from the register.
