<p class="MsoNormal">There needs to be an agreement in place for the individual as well as assurance that they have had appropriate instruction and training. I guess that could be a volunteer contract. Or perhaps the employment contracts are amended to bind
 the individual to the rights and responsibilities as usual, but specifying an unpaid &#8216;transition&#8217; period, with pay only starting at the agreed start date.<o:p></o:p></p>

<p class="MsoNormal">Separate to the general DP issues, you need to consider IT security. How are they accessing this data? Have they been given institution kit/network access but no contract that covers its use (and return if they fail to sign contract)? Are
 they BYOD/cloud access?<o:p></o:p></p>

<p class="MsoNormal">A bit early for a Friday question, so here is a Tuesday tussle.<o:p></o:p></p>

<p class="MsoNormal">An institute is used to a significant amount of staff churn each year (those that employ on seasonal availability e.g. when students are in town or based on seasonal activities e.g. schools starting a new academic year) and as such has
 staff leaving and starting.<o:p></o:p></p>
<p class="MsoNormal">&nbsp;<o:p></o:p></p>
<p class="MsoNormal">They have procedures in place for removing access to the various systems when they have decided it is appropriate (for schools that might be on the last day of the summer hols or it could be at a designated point during the summer, for
 others it could be at the start of gardening leave), but the institute makes a decision on it. That is all fine.<o:p></o:p></p>
<p class="MsoNormal">&nbsp;<o:p></o:p></p>
<p class="MsoNormal">However, when a contract is signed by a new member of staff it has a start date. The institute, however, wants to give access to systems prior to the start of contract to allow the incoming staff a chance to do some prep work or to review
 what work they may need to do. Outside of the quandary of whether this a good thing in an employer/employee relationship, does the fact that the contract has yet to start make any difference?
<o:p></o:p></p>
<p class="MsoNormal">Is it purely reliant on the terms within the contract?<o:p></o:p></p>
<p class="MsoNormal">Could the incoming staff agree to be volunteers for the period up until the contract starts, but signing the contract means that they are also under the obligations of any policies of the institute?<o:p></o:p></p>
<p class="MsoNormal">ICO Helpline thinks that the volunteer aspect is suitable but cannot advise on employment contracts / law.<o:p></o:p></p>
