The ICO’s guidance states that

“The exemption applies to the purpose of processing, not the type of organisation using the personal data. Police forces and HMRC are an obvious example of data controllers which are likely to need to apply the exemption when necessary, but the exemption is not limited to these bodies.”

So you’d have to look at the purposes for which the organisation wants the data. So it could under appropriate circumstances be applied to a private firm.

Subject: [data-protection] Section 29 request

Hi,

Can a section 29 request come from a private firm or does it have to come from a police/security body?

Kind regards,

Gavin
