Yes, I was at an ICO Update Seminar organised by one of our local law firms this morning, and Dave Clancy, the PECR Investigations Manager was giving a presentation on recent developments. He said to "watch this space" for an announcement very soon on some enforcement activity relating to PECR. Rather than cookies, I think he said that it was more related to automated telephone marketing / unsolicited text messaging.

He did also say that he would find it very difficult to imagine a set of circumstances whereby the setting of cookies would attract a monetary penalty, given the limited scope for damage and distress to individuals that could be caused.

I have heard, 3rd hand, that the ICO is planning to announce something major regarding the enforcement of PECR regarding cookies very soon.

My understanding may be garbled, but that is the word on the street.

Has anyone else heard anything similar?

I take your point Chris, but does any individual "in the street" need to (or want to) know what Principle 1 is?

We get very up ourselves in context of the "Act" when the average person just wants to go about their business knowing their information is secure, not that it has to comply with 8 principles.

I can see a need to inform users before they pass personal information over, but what I am saying is that the current methods of "informing" are intrusive and do nothing to promote education or understanding. I came across a site yesterday that would not let me continue to other pages until I had acknowledged cookie use, all I wanted to do was see one of their products! This is what prompted my thoughts.

I see this as more than an irritation. I see it as badly thought out and over legislated law that does nothing but inconvenience the honest and is ignored by others.

Some interesting points from others too. This could be a dissertation for someone!

It is funny that this list will spend ages discussing how many data protection officers can fit on to the top of a needle yet when we look at an item like this which causes a bit of irritation to us all as we surf the net we would be quite happy to have it just removed as an inconveniance. The use of cookies engages principal 1, we should be told.
