Caution needs to be exercised here, the individual making a recording of the meeting for his own personal use is covered under the domestic exemption, however, an organisation making a recording against the consent of the individual for business purposes does not have that same route.

Where I previously worked we came up against this time and again and we had a policy of not allowing private meetings/hearings to be recorded unless all parties agreed. This brought about a deadlock so we decided that as the other party was recording the meeting then we would do so as well and retain the recording. As they are one and the same there would be no real problems for either party.

Is Person 1 entitled to make and keep a recording of the meeting (Person 1 has requested this)?

Am I also allowed to take a copy of the tape at the end of the meeting for my own records (as Person 1 has objected to this)?
