I was asked a simple question by the solicitor.  How bloody minder are they likely to be over this?  My reply was instantaneous in that they were likely to be very bloody minded and the solicitor said that I had to make my mind up but did I really want that much hassle.  In short the answer was no.  Depends how good a poker player you are and if you have the money to pay legal fees to bluff it out.  The solicitor also stated that the smell could follow me for quite some time in employment circles that you breach contracts and agreements.

I had a similar issue with relocation expenses - had to pay back within a certain time frame blah blah. The advice I got at the time was that it would be too expensive to pursue through the courts and that its not enforcable (but doubtless repayment might  be strongly requested). Whether it is pursued depends (apparentl) on the individual circumstances - if you leave a months after completion of a two year course you are far more lijkely to get a stroppy response I think than if you leave it for say 12 months or more. However - this was some time ago - maybe the current financial situation may have sharpened employers teeth on this subject

Do you have any information to support this Sharon.  In my personal experience it is very enforceable.  Whether verbal or written a contract is legally binding and we can’t just pull out when it suits us.  If that was the case my mortgage company would have been given the Harvey Smith’s by now…lol.

I think you`ll finfd that this is a common practise but most employment lawyers would say that its un - enforceable
