Hi, we do not broadcast at present but if we did, I would probably consider the following
The Council is a creature of statute and so can only do something where it has the statutory power or obligation to do so
the Council is anxious to engage with the public to encourage democratic participation in and accountability of decision making by Committees.
A way that is necessary to do this would be by broadcasting the meetings.
The Council exercises its Power to Advance Wellbeing (in Scotland) I think that it may be something along the lines of general competence and so the broadcasting is now necessary in connection with a statutory function/public task and so no consent is required.
However, it should only be the participants whose images are broadcast and so cameras etc. should not point at members of the public attending the meeting. So the Council would identify positions of the cameras that would not catch members of the public or if impossible the minimum members of the public concerned. If possible there should be an area set aside for those who don't want to be broadcast. However, if there is no alternative but to cover the public as well then it would be a balance between the rights of the members of the public against the public interest in the broadcast. Unless there is a very good reason as to not to, the public interest would trump the fact that a member of the public attended the meeting - very low level personal data.
In those cases we would just put up a sign saying that the broadcasting is happening and if possible direct members of the public to areas which will not be caught.
In relation to participants, they would just be told that their contribution would be broadcast unless they can identify one of the grounds to exclude the public and so stop the broadcast set out in your Local Government Act 1972.
