For public authorities, certainly, it's worth noting that the common law duty of confidentiality may extend beyond death (Pauline Bluck v The Information Commissioner UKIT 2006 EA).
Jon Baines or Tim Turner of this electronic parish will certainly correct me if I'm wrong: wasn't there quite a lot of discussion around a tort of breach of privacy during the Leveson Inquiry, which was subsequently squished as "too hard"? (serious paraphrasing going on there, I should be working, I'm recalling the Watson submission and consideration of same, probably inaccurately).
