We used to have a listening comprehension examination that was done in our centre for language learning (from Arabic to Spanish). Now it has been replaced by an online examination. Though some Tutors created their own text and record it themselves, some other use 1 or 2 tracts of commercial CDs (for example Minna No Nihongo for Japanese, Prisma for Spanish etc). I have just been asked to upload on the VLE (my library page) two extracts of a commercial CDs as mp3 files. I don’t think I ought to, as I believe there is no more copyright exceptions for examinations, (and though there is permission to copy extracts of audio files, I took this permission on a one reader basis, not all students on a class.) Yet, on the other hand, I would feel it is fair dealing.
I have purchased the second edition of Copyright and e-learning by Jane Secker but cannot quite find the answer there. I think there are copyright exception for film studies for example, but not quite for language learning. And as we are pushed to use our VLE a lot, this proves difficult...
Also, I always push them to create their own material (whether text or audio) but it is difficult are quite a few of them are paid by the hour.
