We represent the legal asylum interests of a Somali national who already for more than 15 years is trying to get his asylum request honored by the Dutch authorities.
Particularities of the case:
fled on the age of 6 Mogadishu to Yemen
arrived in the NL in 2001 as an unaccompanied minor at the age of 17
belongs to the Reer Hamar (Banadiri, Shanshiye clan - light skin color) and lived in Hamar Weyne, Mogadishu
for more than 13 years the NL authorities did not accept him to be from Somalia
now (2014) based on a language test the NL authorities accept him to belong to the community of native speaking Somali's
for the Somali Embassy in Brussels our client is without any doubt Somali and indeed from the Reer Hamar - Benadiri
He now has to prove he is indeed from Mogadishu and that it is not safe for him to return. As you may know, most Somali's who fled their country without papers when the civil war started, have no means to prove by papers that they are who they claim they are to be. We are concerned that the client unless he is able to submit 'objective proof' that he originates from Mogadishu | Hamar Weyne and/or that his life is at risk when he is forced to return, his asylum rights will be denied again and that this time he will be deported to Somalia.
We have following questions for you:
Do you have any information on
what a forced return of someone like our client would mean in terms of not having any social- or family/clan network on which he can call for help?
the Reer Hamar, Shanshiye - Benadiri today in Mogadishu and their position?
Any suggestions for our client on how he can prove where he originates from, i.e. that he orginates from/lived in Mogadishu, Hamar Weyne?
What risks exist for someone who has been for almost 15 years in Europe and who left due to the civil war at the age of 6 his home country to be forced to return to Somalia?
To what risks will he be exposed when forced to return, with the presence & activities of organisations such as Al-Shabaab? Our client speaks fluently Dutch and has spent most of his life in The Netherlands.
Any referrals to whom we can turn ourselves for further expert advice?
Is there any way that you can respond on short notice? Your help and assistance is highly appreciated.
