I'm not sure about the legality. However, there are some courses where a
particular disability simply precludes participation - as the learner
will not be able to meet key learning objectives. In such cases, it
seems inappropriate (cruel, even) to offer a place - without discussing
the issues beforehand. I realise, however, that such an approach could
*theoretically* be abused by uni staff - so maybe the second option is
generally advisable. It's a tricky issue, which has been discussed in
depth in the past - but which is still worth revisiting.
