Dear Jack and Jason,
Thank you for raising the issue of the copyright statement found on the
ProQuest Dissertation & Theses Global database.
ProQuest claims copyright in the collation, organization and presentation
of the content that comprises the database. We do not claim copyright over
the theses contained in the database. In fact, each theses contains a
statement that the copyright is owned by the author.
We have heard from others recently that the copyright statement is
confusing to some. We are working with our teams to determine how we might
change the statement to alleviate any confusion caused.

PQ have no rights whatsoever over the content, or the metadata (if it was
harvested from your IR) - unless they have embellished the records. Even
if they have scanned the theses from print the new Reuse of Public Sector
Information Regulations provide cover for this. I have always been very
surprised that institutions would let PQ harvest their OA theses and sell
them, and by why anyone would subscribe to such a product when most of that
content is freely accessible.
A stop could be put to it quite easily.

Hi,
I notice that Proquest are claiming copyright of Dublin City University
theses hosted on our IR and indexed on ProQuest Dissertations & Theses: UK
& Ireland. The theses are open access and as far as I know, the authors own
the copyright. They are also doing this with works from other IRs.

What do you think Proquest are claiming copyright of: the thesis or the
metadata? Even if it's just the latter, do they have any real rights here?
