SEMINAR: 'The Extraterritorial Application of the Non-refoulement Obligation in International Human Rights Law' – Dr Ralph Wilde (UCL)

The mainstream view of international human rights law, again not without its dissenters, is that this area of law does apply extraterritorially. Insofar as the standard views of refugee law, on the one hand and human rights law, on the other hand, are correct, the latter area of law has the potential to make a significant difference extraterritorially, in providing a normative framework protecting individuals in the context of transfers that would otherwise be absent. The present paper explores this potential, by analysing the main relevant judicial decisions, notably in relation to transfers at sea and in the context of foreign military operations.
Bio: Ralph Wilde has been a member of the Law Faculty at University College London, University of London since July 2002. He is an expert in public international law, and also has an interest in the interface between international law and related academic disciplines, including international relations and legal and political theory. He is currently continuing his work on the extraterritorial application of human rights law. His publications on this topic include ‘Legal “Black Hole”?: Extraterritorial state action and international treaty law on civil and political rights’ (2005) 26(3) Michigan Journal of International Law 739 – 806.
