We charge for pre-application advice (and HER searches are billed at the same rate as other archaeology pre-apps).
We don't charge for producing briefs, but if the approved WSI is part of a planning condition there is a fee to discharge the condition(s).

Are there any other unitary authority Archaeology Services out there charging for producing archaeological briefs, monitoring fieldwork and approving reports in relation to planning conditions? We are aware of a number of two-tier authorities that do but are particularly interested in cases where it is the Local Planning Authority setting out archaeological conditions, who then in turn directly charges the developer for the provision of archaeological advice needed to help meet this condition (this is one-step removed in two-tier authorities but would suggest this could still be interpreted as a 'grey area'). How have any of these unitary authorities dealt with the risk of being accused of creating a 'monopoly'? We have always argued that the costs recovered are not profits but partial or full-cost recovery only.
This matter has been recently raised with us and it has been suggested that if challenged, we give the developer the option of letting a contractor/consultant set the brief and monitor another unit doing the fieldwork (I know, I know ...many reasons aganist this). At best, we would maybe consider the developer approaching another LPA archaeological adviser but I don't think many of us want to go down that route either. And this is still not free reign for the developer as to who they approach.
Any thoughts/comments gratefully recieved.
