Hi all, quick question. If we're transfering services and TUPE staff out, we have schedule 3 condition (for employment purposes) to pass data over to new provider without consent if necessary until wedo a new fair processing notice etc.
If however we have service user data that the new provider needs in advance of contract being signed on the dotted line too, are there any schedule 3 conditons that apply? Clearly we'd like consent asap from service users but if we couldn't get consent for any reason, anyone think of a way of justifying the sharing without it at this stage? Am I missing an obvious one?
