As the newly appointed Chair of Council I just wanted to comment on a couple of points. My main role is to listen and ensure - as Phil says - that all these views are shared with Council and that they are carefully considered as we go forward. The consultation is wide ranging and all the views will be brought together. The FAQ will be updated to reflect comments received and I will ensure that a summary of views received is made available to all.
I did want to clarify a couple of points though. First, the issue of whether staff can become Trustees. There is strong assurance over this in the Charity Commission advice and regulations. Staff cannot be trustees of a charity unless this is specifically allowed for in the bylaws, if permission is given by the Charity Commission agrees, or it is approved by a court of law. Our bylaws do not allow for staff to become trustees. This is covered in the Charity Commission publication CC3 The Essential Trustee.
Of more concern is Charles' comment that one Trustee has been told not to publicly express their views on the proposals. Clearly I am not party to any discussions Charles has had with any Trustees. I am only aware of discussions on collective responsibility, which I am sure that everyone involved in charities is aware of. Again this is covered in The Essential Trustee which makes it clear that in a charity all trustees are required to take collective responsibility for decision making and must take personal responsibility for those decisions.
