I would also want to know what his medication is and whether it causes drowsiness... Part of the risk assessment I expect.

I have recommended that he is not fit to be at work and he has been reviewed by rehabilitation serivce who have recommended physio - 28.3.13. He insisits to HR that he is fit to undertaken the contracted role and they have said he can return to work. I get on well with HR so this is not a case of who is right and HR are not listening. I just wondered if anyone knows the legal position with this as even HR were at a loss. What if the individual is insistant that they are fit to resume full contracted role can they return to work although it is likely they will be exacerbating the symptoms by doing so?? I understand that finances pay a big role in this and he will only be getting statuatory pay. Thanks in advance for your comments.
