The data your insurance company asked for may well be excessive, but I think
it is unrealistic to expect the person who is calling you to be able to
explain the DPA justification. In fact if they tried, it could be
dangerous. An organisation the size of an insurance company would not want
individuals at that level to understand the fine detail of Data Protection
or make their own judgements on how to apply the Principles. So I would
expect the person making the call to have a script for the questions to ask,
and a procedure for handling responses that go off script. In this case the
trigger words 'data protection' should result in the question being passed
to someone who is responsible for the organisation's compliance and
therefore competent to explain.

Fellow thinkers.
I was completing a claim form on the phone with my insurance company and
amongst other things they asked me the following questions. Did I have a
criminal record other than road traffic offences. Now I have seen this
question on most insurance applications I have made and it always arouses my
curiosity as to what condition in schedule 3 they have satisfied in order to
process that sensitive personal data. I have repeatedly asked insurance
companies this question but never received an answer that in my view
indicates the person providing it had much knowledge of DPA. I can
understand, but not necessarily agree, the purpose of the question from a
risk management perceptive, but does anyone out there have a DPA answer?
Two further questions were; do I have any county judgements; have I ever
been declared bankrupt? The question of relevance springs to mind. I have
never seen any evidence to support the view that indebtedness raises any
integrity issues.
Can anyone throw any light on this?
