Advance notice of this was circulated to the sector via our Archive Sector Update for Winter 2011. Judy's circular was aimed at local authorities in general, rather than archives, libraries and museums in particular. The text of the original Commission proposals can be found here:

The text is not finalised yet, but just to clarify, the intention is that although archives, libraries and museums are likely to be brought within scope of the Directive for the first time, they will be subject to a more limited set of provisions than other public bodies. In particular there will be :
• no compulsion to allow re-use;
• greater flexibility in terms of setting levels of charging;
• no requirement to provide details of third party copyright ownership (as such material is out of scope)
Exclusive licensing arrangements designed to lever in private funding for digitisation remain acceptable, although there are likely to be some constraints, for example on the duration of any agreements.
Negotiations on the details of the text are continuing. In order to inform the UK negotiating position, The National Archives has been in discussions with various representative cultural sector bodies, including ARA/CALGG, about the potential impact. We hope to circulate a brief (10-15 minutes to complete) survey to CALGG members shortly, to pick up on various issues where we need to further information.
We will be providing sector-specific guidance and training once we have a final text on which to base this. The more extensive provisions applying to the rest of the public sector mean that they will need to start preparing for the changes rather earlier than that, hence Judy's circular.
