I am doing some research on the application of Article 1F(b) to people who have been found not criminally responsible for criminal acts by reason of their mental health. I am aware of the reference to criminal responsibility and insanity in the UNHCR’s Guidelines on Exclusion. I have also reviewed commentary on the Guidelines published in the International Journal of Refugee Law. I am interested in compiling legal cases that touch on this issue in the domestic context. If anyone knows of such cases, I would be most appreciative of a response.
